1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and Realynq Technologies ("Realynq", "we", "us"). By using realynq.com (the "Site") or joining our launch list, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
You must be at least 18 years old to join the launch list.
2. What the Site is, and what it isn't
The Site is a pre-launch page. It describes a product that is still being built. Features, timing and availability described on the Site, including our planned launch in Houston, are our current plans, not promises, and may change.
Realynq Technologies is a technology company. We are not a licensed real estate broker or agent, mortgage broker, lender, attorney, accountant or financial adviser. Nothing on the Site is real estate, legal, tax, financial or investment advice, and using the Site does not create an advisory, fiduciary or client relationship with us. For decisions about buying, selling, renting or financing property, consult licensed professionals.
When the Realynq product launches, your use of it will be governed by separate terms that we will show you before you start.
3. Joining the launch list
- By submitting your email address, you ask us to contact you about Realynq's launch and early access. Every email we send includes an unsubscribe link, and you can also ask us to remove you at any time.
- Use your own email address and give us accurate information. Do not sign up on someone else's behalf without their permission.
- We may decline or remove signups that appear automated, fraudulent or abusive.
- Our Privacy Policy explains what we collect when you sign up and how we handle it.
4. Acceptable use
When using the Site, you agree not to:
- use bots, scrapers or other automated means to access the Site or submit the signup form, other than search engines following our robots.txt file;
- submit false information or another person's email address;
- try to bypass our bot checks, rate limits or other protections;
- probe, scan or attack the Site or the systems behind it, or interfere with how it works;
- copy, frame or republish the Site or its content for commercial purposes;
- use the Site in any way that breaks the law, including fair housing laws.
5. Our content
Everything on the Site, including the Realynq name and logo, the text, illustrations, design and code, belongs to Realynq or its licensors and is protected by copyright, trademark and other laws. We give you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial purposes. No other rights are granted, and nothing on the Site gives you a right to use our name or logo.
6. Third-party links and services
The Site links to services we do not control, such as our Instagram profile, and relies on providers such as Cloudflare and Amazon Web Services (AWS) to run. When you use a third-party service you are dealing with that company, not with us, and its terms and privacy policy apply. We are not responsible for third-party services.
7. Fair housing
Realynq supports the federal Fair Housing Act and the Texas Fair Housing Act. We are building our product to help people find and finance homes without discrimination based on race, color, religion, national origin, sex, familial status, disability or any other characteristic protected by law, and we expect the same of everyone who uses the Site.
8. Disclaimers
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. We do not promise that the Site will be uninterrupted, error-free or secure, or that the information on it is complete or current.
9. Limitation of liability
To the fullest extent permitted by law, Realynq and its officers, directors, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of or related to your use of the Site, even if we were advised such damages were possible.
Our total liability for all claims relating to the Site will not exceed the greater of the amount you paid us to use the Site, which is currently nothing, or one hundred US dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of sections 8 and 9 may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
10. Your responsibility for misuse
If a third party brings a claim against Realynq because you broke these Terms or misused the Site, you agree to cover the resulting losses, including reasonable legal fees.
11. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
If you have a dispute with us, email info@realynq.com first and give us 30 days to try to resolve it informally. If we cannot, any claim must be brought in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts.
12. Changes to the Site and these Terms
We may change, suspend or shut down the Site at any time. We may also update these Terms. If we do, we will post the new version here with a new effective date, and if the change is material we will email the launch list before it takes effect. Using the Site after a change takes effect means you accept the updated Terms.
13. General
- These Terms and the Privacy Policy are the entire agreement between you and Realynq about the Site.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- If we do not enforce a provision right away, we can still enforce it later.
- We may assign these Terms to a successor of our business. You may not assign them.
- Sections 5 and 8 through 13 survive if these Terms end.
